Job Full Description
The Medical Director will serve as the legally responsible physician for the medical spa and ensure full compliance with all federal, state, and local laws governing aesthetic and wellness services. This role provides oversight for clinical protocols, supervises advanced practice providers (APRNs, PAs), and ensures all procedures are performed within the scope of practice under Florida law.
Essential Duties & Legal Responsibilities
Regulatory Compliance & Governance
- Maintain an active, unrestricted Florida medical license and board certification as required.
- Serve as the physician of record for the med spa in accordance with Florida Board of Medicine and Department of Health regulations.
- Develop, review, and update all standing orders, treatment protocols, and informed consent documents to meet legal and ethical standards.
- Ensure all procedures offered (e.g., body contouring, laser treatments, neurotoxins, dermal fillers, IV infusion therapy) are FDA-cleared for their intended use and performed by appropriately licensed and trained personnel.
- Conduct and document regular patient chart reviews and quality assurance audits at legally mandated intervals.
- Monitor compliance with OSHA, HIPAA, and state infection control standards.
Supervision & Delegation
- Enter into and maintain written Collaborative Practice Agreements with APRNs and PAs per Florida Statutes §§ 458/459.
- Approve scope-of-practice guidelines and supervise delegated medical tasks, including prescribing, administering injectables, and IV therapy.
- Ensure delegation complies with Florida’s Nurse Practice Act and Physician Assistant Practice Act.
- Provide real-time availability for consultation when staff are delivering medical services under delegation.
Controlled Substances & Risk Management
- Oversee the procurement, storage, and dispensing of prescription medications and controlled substances in compliance with DEA and state regulations.
- Implement adverse event reporting, incident documentation, and corrective action protocols.
- Maintain malpractice insurance coverage consistent with Florida’s financial responsibility requirements.
Documentation & Record-Keeping
- Maintain complete, accurate, and timely medical records as required by Florida law.
- Ensure patient consent forms, treatment records, and follow-up documentation are compliant and securely stored.
- Support audits by regulatory agencies, payers, or legal entities as necessary.
Training & Continuing Education
- Provide ongoing staff training in compliance, infection control, and patient safety.
- Maintain CME/CE credits to remain compliant with Florida licensure requirements.
- Ensure all staff maintain device-specific and procedure-specific certifications.
Minimum Requirements
- Medical Degree (MD or DO) from an accredited institution.
- Active, unrestricted Florida medical license in good standing.
- Board certification in Dermatology, Plastic Surgery, Family Medicine, Internal Medicine, or related specialty.
- Minimum of 3 years post-residency clinical experience, preferably with aesthetic medicine exposure.
- Knowledge of Florida regulations for medical spas, supervision, and delegation of medical tasks.
